Court Orders 3.5 months jail in cheque bounce case

In 2017, Rahul Nivritti Gunjal, a resident of Narhe, borrowed Rs 3 lakh from his friend Bapu Nathu Akhade. However, things took a turn when Rahul tried to repay the loan by issuing a cheque that bounced. This led Bapu Nathu Akhade to file a case against Rahul for issuing a bounced cheque.

The case was heard by Judicial Magistrate First Class AA Pandey. After examining the evidence, the court found Rahul guilty and ordered him to pay the outstanding loan amount along with additional compensation. The judgment didn’t end there; Rahul was also sentenced to three-and-a-half months in prison for his actions.

Legal Actions and Court Orders

The complainant, Bapu Nathu Akhade, was represented by his lawyers, Adv Shiom Pandit and Adv Bipin Devarkar. They presented the case against Rahul, which led to the court’s decision to impose the imprisonment and financial penalty.

On April 15, the court officially ordered that Rahul be imprisoned for three months. Additionally, he was instructed to pay Bapu Nathu Akhade Rs 2.9 lakh. The court further stated that if Rahul failed to pay the fine, he would face an additional 15 days of simple imprisonment. To enforce the court’s orders, the Sinhagad Road police were directed to arrest Rahul and send him to Yerawada Jail.

The Appeal and Further Developments

Rahul was given 30 days to appeal the court’s decision. During this period, the implementation of the sentence was put on hold. However, Rahul neither compensated Bapu Nathu Akhade for his loss nor appeared in court on May 16 as required. He did appeal to the sessions court, but there was no stay granted on the original order passed by Magistrate Pandey.

Magistrate Pandey remarked on the situation, stating, “As on today, the convict has preferred an appeal with delay condonation application. Therefore, the fate of suspension of the sentence has already reached the domain of the court. It is already two months which is the stipulated period for preferring an appeal against the judgment of conviction of this court. Therefore, on these two reasons, this court has no authority left in itself to grant any suspension of sentence.”
