In a major step towards modernizing the judicial system, the Bombay High Court has announced the implementation of new video conferencing rules for courts across Maharashtra, Goa, and the Union Territories of Daman and Diu, and Dadra and Nagar Haveli. The new guidelines, titled “High Court of Bombay Rules for Video Conferencing for Courts 2022,” will come into effect on December 29.

The rules, published in the official gazette on December 19, aim to improve the efficiency and accessibility of judicial proceedings. They will be applicable to various courts, including Family Courts, Labour Courts, Industrial Courts, Co-operative Courts, Motor Accident Claims Tribunals, and School Tribunals.

Key Features of the New Rules

  1. Recognition of Virtual Hearings: Video conferencing hearings will now be officially recognized as formal judicial proceedings. All participants must provide government-issued identity proof or other personal details to join. Unauthorized recording of proceedings is strictly prohibited to maintain the integrity and security of virtual hearings.
  2. Technical Arrangements: Designated coordinators will manage the technical setup at both the court and remote locations. Participants are required to use desktops or laptops with stable internet connections to avoid disruptions. Coordinators will ensure all systems and participants are ready at least 30 minutes before the scheduled hearing.
  3. Special Provisions for Witnesses: Witnesses located abroad or in custody will be allowed to testify through secure video links managed by local authorities or Indian consulates.
  4. Submission Process: Requests for video conferencing must be submitted in a prescribed format, and all necessary documents should be shared electronically in advance to ensure thorough preparation.
  5. Expanded Scope: Judicial remand, framing of charges, and examinations of accused persons under the Code of Criminal Procedure can now be conducted via video conference. However, certain situations, such as judicial or police remand, will require exceptional circumstances to be recorded in writing.

The introduction of these rules is a progressive step towards integrating technology into the judicial process. It ensures that court proceedings are transparent, secure, and accessible to all parties.

Cost of Video Conferencing

The technical expenses for video conferencing will generally be borne by the requesting parties unless the court decides otherwise.

By adopting these modern guidelines, the Bombay High Court aims to streamline judicial processes and make them more efficient, setting a benchmark for the integration of technology in India’s legal system.
