
In a recent development, the High Court has taken a firm stance on the issue of a house possession that has been elusive even after a court order. During the hearing of a petition filed by Union Bank of India, the court issued an ultimatum to Guna Collector, stating that he must comply with the order by May 9 or personally attend the hearing.
The case revolves around a 2350 square feet house located in the village of Mayana in Guna. The former Collector of Guna had previously issued an order for the possession of the house. According to Harshvardhan Topre, the advocate representing the bank, Aaram Bai and Sunil Yadav had taken a loan of Rs 9.5 lakh. However, despite several opportunities to settle the outstanding amount, they failed to make the necessary payments. As a result, the bank initiated recovery proceedings.
In 2020, an appeal was made to the Collector, but no action was taken. Consequently, a petition was filed in the High Court in 2022 to address the matter. The court’s recent ultimatum highlights the seriousness of the situation and emphasizes the need for the Guna Collector to fulfill the court’s order promptly. Failure to comply could have significant consequences for all parties involved.
