Under the Bankers’ Books Evidence Act, 2026, the statutory protection has been granted to bank employees, which functions as a shield against procedural harassment in cases where the bank is not a direct party to the litigation.

Witness Exemption: A bank officer cannot be routinely compelled to appear as a witness to testify or prove the existence of financial transactions.

Physical Ledger Safeguards: Courts and investigating agencies (including the police under the Bharatiya Nagarik Suraksha Sanhita, 2023) cannot demand original physical ledgers, hard drives, or localized servers.

Sufficiency of Certified Extracts: The law dictates that a properly certified printout or electronic data extract serves as prima facie evidence. The certificate completely replaces the physical presence of the banker.

The 2026 framework prevents fishing expeditions by law enforcement or litigants:

Right to Be Heard: If a court or investigative authority demands an inspection or a specific record, the bank has the express right to oppose the direction.

Mandatory Judicial Hearing: If a bank objects to a disclosure or an inspection request, the court must formally hear the bank’s arguments before issuing any final compliance order.

Because bankers handle sensitive customer data, complying with vague data requests poses a risk of legal liability for wrongful disclosure.

Judicial Order Mandate: The Act reinforces that banks are only permitted to allow the inspection of records or produce certified copies upon a lawful order from a court performing judicial functions.

Statutory Compliance Shield: When a banker releases data under the strict certification guidelines of Schedule I or Schedule II of this Act, they are legally protected from corporate or civil liability regarding consumer privacy violations, provided the data matches the system logs.
