Consumer Forum Holds Union Bank of India Liable for ATM Transaction Error

The III Additional District Consumer Disputes Redressal Commission in Bengaluru Urban (Karnataka), chaired by Shivarama K as President and Rekha Sayannavar as Member, held Union Bank of India responsible for failing to refund funds incorrectly debited from the complainant’s bank account during an ATM withdrawal.

Key Details:

The complainant attempted to withdraw Rs. 5,000/- and Rs. 3,000/- from a Union Bank of India ATM using his card twice. However, despite the deductions from his savings account, no cash was dispensed. Despite several email exchanges, the complainant did not receive a satisfactory resolution from the bank. Aggrieved by this, the complainant filed a consumer complaint against the bank with the III Additional Bangalore Urban District Consumer Disputes Redressal Commission. The bank did not appear for the proceedings.

Findings by the District Commission:

Upon examining a photocopy of the bank statement, the District Commission noted that on April 26, 2023, Rs. 5,000/- and Rs. 3,000/- were debited from the complainant’s account. The bench also observed that the bank did not dispute this oral and documentary evidence. Consequently, the District Commission concluded that the bank was at fault.

As a result, the District Commission directed Union Bank of India to reimburse the complainant Rs. 8,000/- along with an annual interest rate of 9%. Additionally, the bank was ordered to pay Rs. 3,000/- as compensation for mental distress and litigation costs.
