The Permanent Lok Adalat in Udaipur has directed Bank of Baroda to release the money deposited in four fixed deposits (FDs) to a man who had been waiting for nearly five years to receive the funds left to him by his late mother. The bank has also been ordered to pay Rs 32,000 as compensation for mental agony and the expenses incurred in filing the complaint.

According to the order, the bank must release the full amount deposited in the four FDs, along with the applicable interest. The court has also directed the bank to comply with the order within one month. If the bank fails to do so, it will be liable to pay interest at the rate of 9% per annum, calculated from October 21, 2021, until the date of actual payment.

The case relates to Sanjay Paliwal, a resident of Udaipur’s Central Area, whose mother, Manohar Devi, had executed a registered will on December 1, 2008. Through the will, she bequeathed the money deposited in the bank to her son. She passed away on April 1, 2021, after which Sanjay approached the bank to claim the money held in the four fixed deposits.

On October 14, 2021, Bank of Baroda asked him to submit a probate of the will before releasing the funds. However, Sanjay, through his legal counsel, informed the bank that a High Court ruling clarified that probate was not mandatory in Rajasthan in the circumstances of his case. Despite this clarification and repeated requests, the bank did not release the money.

After waiting for several years, Sanjay filed a complaint before the Permanent Lok Adalat on April 15, 2026, seeking the release of the fixed deposit amounts and appropriate compensation for the delay.

During the proceedings, the court observed that the bank could not clearly explain what additional documents were required to release the funds. The court also noted that no other person had come forward to claim the money and that no objection had been raised against the registered will.

Considering these facts, the Permanent Lok Adalat directed Bank of Baroda to release the entire amount deposited in the four FDs, along with interest, and pay Rs 32,000 as compensation for the mental distress and legal expenses suffered by the complainant.
