Kotak Mahindra Life Insurance Company is under severe scrutiny of mis-selling of insurance products. Calls have been raised for an investigation by the Insurance Regulatory and Development Authority of India (IRDAI) and the Central Bureau of Investigation (CBI) into alleged insurance fraud and systemic mis-selling associated with Kotak Mahindra Life Insurance.

In FY 2024–25, Kotak Mahindra Life Insurance reported 1,730 customer complaints, of which 1,115 (about 64.5%) were categorized under “Unfair Business Practices”. The figures have raised questions about the insurer’s sales practices, distribution channels and customer grievance management.

The data, disclosed in the company’s Form L-41 grievance statement, show that unfair business practice complaints accounted for approximately 64.5% of all complaints received during FY2024-25.

The figures do not establish that the allegations were proven or that the company committed systematic misconduct. However, they highlight areas that may warrant closer regulatory examination.

Industry-Wide Mis-Selling Concerns

The issue comes against a broader backdrop of concerns about unfair sales practices in the life insurance industry.

According to the Insurance Regulatory and Development Authority of India’s (IRDAI) Annual Report 2024-25, total grievances against life insurers declined slightly from 1,20,726 in FY2023-24 to 1,20,429 in FY2024-25.

However, complaints classified as unfair business practices increased from 23,335 to 26,667 during the same period, a rise of approximately 14.3%.

Their share of total life insurance grievances increased from 19.33% to 22.14%.

The regulator has highlighted mis-selling as a significant concern and emphasised the importance of analysing the causes of complaints, assessing product suitability and strengthening controls across distribution channels.

Commission Payments of Nearly ₹1,425 Crore

Kotak Life’s FY2024-25 financial statements disclosed total commission payments of approximately ₹1,424.98 crore.

The reported breakdown was as follows:

Commission CategoryAmount
First-Year Premium Commission₹519.82 crore
Renewal Premium Commission₹271.39 crore
Single-Premium Commission₹633.77 crore
Total Commission₹1,424.98 crore

Commission payments are a normal part of the insurance distribution system and are not, by themselves, evidence of misconduct.

Historical Regulatory Actions and the Exide Life Dispute

Kotak’s insurance operations have also faced regulatory scrutiny in the past.

In September 2012, IRDAI imposed a penalty of ₹22 lakh on Kotak Mahindra Old Mutual Life Insurance. The regulatory findings concerned several matters, including death-claim procedures, payments involving master policyholders and changes to group insurance plan terms.

An earlier regulatory action in October 2008 had also raised concerns about aspects of the company’s insurance operations, including death-claim processing and certain policy practices.
