Supreme Court cancels Bail of Dheeraj Wadhawan in Rs.34000 Crore Bank Fraud Case by DHFL

The Supreme Court of India has cancelled bail of Dheeraj Wadhawan who is accused in massive ₹34,000 crore bank fraud case related to DHFL (Dewan Housing Finance Corporation Limited). Earlier, the Delhi High Court had granted bail to Dheeraj Wadhawan on medical grounds.
Dheeraj Wadhawan and his brother Kapil allegedly defrauded a consortium of 17 banks to the tune of Rs 34,000 crore, making it the biggest banking loan fraud in the country. They defrauded the consortium of Rs 34,615 crore by defaulting on loan repayments from May 2019 onwards. As per reports, the fund was misused and diverted.
During the hearing, the Supreme Court took a cautious and detailed approach by forming a medical board comprising doctors from Sir J.J. Hospital, Mumbai, to independently evaluate the medical condition of Dheeraj Wadhawan. This step was taken to ensure that the bail granted earlier was indeed justified on health grounds. After examining him, the medical board submitted its report to the Court, concluding that Wadhawan did not require any immediate medical treatment or support.
A team of 11 Doctors undertook the physical examination of the respondent, Dheeraj Wadhawan, and furnished report dated 09.07.2025. The health parameters of the respondent, Dheeraj Wadhawan, under the heads of General Medicine, Dermatology, General Surgery, Psychiatry, Cardiology, Pulmonary Medicine, ENT, Neurosurgery, Urology, Nephrology and Orthopedics were examined.
The Committee said that there was no necessity for hospitalization of Dheeraj Wadhawan and Dheeraj Wadhawan, does not need to attend the hospital on a daily basis.
Despite strong arguments from the lawyers representing Wadhawan, the Supreme Court found no valid reason to uphold the bail. As a result, it set aside the Delhi High Court’s order dated 09.09.2024 and directed Dheeraj Wadhawan to surrender within two weeks. The Central Bureau of Investigation (CBI), which is investigating the case, was represented in court by Shri S.V. Raju, the Learned Additional Solicitor General (ASG).

Well appreciated order by Hon’ble SC. White collar criminals are causing more ripple in system. They dent the public faith in system. But why not same principle applied for political prisoners who even after causing more alarming loss to public consciences, get 5 star facilities during their jail term and after bail, parol become active again. Unless Hon’ble HC / SC would show resilience to punish these strong person who are politically or economically strong, there will be question mark always, on if rule of law do exist or applicable uniformly ?
