Is a cheque invalid if different inks are used on it? Kerala High Court has given an important verdict on the case.
The Kerala High Court has ruled that a cheque cannot be considered invalid simply because its signature and other details were written using different inks. The court said there is no legal requirement that the date, amount and signature on a cheque must be written in the same ink.
Different Ink Is Not Enough to Doubt Cheque
Justice A. Badharudeen observed that using one ink for the signature and another ink for the other details does not by itself make a cheque invalid. The court also said that the difference in ink alone cannot be used to automatically doubt whether the cheque was properly issued.
The court made these observations while hearing an appeal filed by D. Chandran in a case involving a ₹7 lakh cheque issued by S. Anilkumar. The cheque was dishonoured with the reason “payment stopped by drawer.”
