Supreme Court Upholds Bank Manager’s Dismissal, Says Senior Officers Can’t Seek Same Punishment as Juniors

The Supreme Court of India has said that a senior officer cannot ask for the same lighter punishment given to junior employees for the same misconduct.

A bench of Justice Dipankar Datta and Justice Satish Chandra Sharma upheld the dismissal of a senior manager of Punjab & Sind Bank.

The manager was found guilty of working with a junior bank officer and a gunman to misuse customers’ money for personal gain.

The Court allowed the bank’s appeal and cancelled the earlier decision of the Delhi High Court. The High Court had reduced the punishment from dismissal to compulsory retirement.

The High Court had given this relief because the other employees involved in the case received lighter punishment.

However, the Supreme Court said this was wrong. It explained that a senior manager has more responsibility than junior staff. So, their punishment can be stricter.

The Court said that higher position means higher responsibility and accountability. The senior manager was not only expected to follow rules but also to supervise others.

The Court also said that junior employees with limited powers cannot be treated the same as a senior officer.

It added that giving a harsher punishment to a senior officer is not unfair or shocking.

The senior manager had nearly 37 years of service. He was found guilty of misusing customer funds and changing bank records.

While the other employees were given lighter punishments like salary reduction and compulsory retirement, the senior manager was dismissed from service.

The High Court had earlier said this difference in punishment was unfair under Article 14 of the Indian Constitution.

But the Supreme Court disagreed. It said equality does not mean everyone must get the same punishment, especially when their roles are different.

The Court also said that courts should not interfere in disciplinary decisions unless they are clearly unfair or unreasonable.

Finally, the Supreme Court upheld the dismissal of the senior manager and allowed the bank’s appeal.
