District Consumer Disputes Redressal Commission Shamli has ordered Oriental Bank of Commerce Thana Bhawan Branch’s former manager to pay a fine of Rs. 50,000 for not fulfilling his legal responsibilities and filing a false complaint against a farmer.
On 5th July 2016, Narendra Kumar, a resident of Kadi village, filed a complaint with the District Consumer Disputes Redressal Commission Shamli, stating that he is an illiterate and ordinary farmer. He claimed that the former manager of Oriental Bank of Commerce Thana Bhawan Branch and Rajesh Kumar, a resident of Hiranwada village, conspired against him and falsely showed him a tractor loan. The complainant stated that Rajesh Kumar took him to the bank and told him that he needed the bank account documents, guarantor’s introduction, and signature of the introducer. He signed as the introducer, and he became aware of this loan on 18th May 2016 after receiving a notice from the bank. After this notice, the process server repeatedly visited his house for recovery from the Tehsil, which caused him significant mental distress as he had not taken any tractor loan.
The Chairman Hemant Kumar Gupta, members Amarjeet Kaur and Abhinav Agarwal dismissed the complaint against Rajesh Kumar during the hearing and ordered a penalty of Rs. 50,000 against farmer Narendra Kumar for filing a false complaint and not fulfilling his legal responsibilities as per the former manager of the bank in 2015. The order also stated that the entire penalty amount should be deposited in the treasury within 45 days as per the rules of the fine.
